Marriage License
Marriage License Information
- Domestic Relations Title 32
- Marriage License, Certificates and Records Idaho Title 32-4
- Marriage licenses are issued in the Recorder’s Office located at 206 1st Avenue South, Suite 200, in Hailey, Idaho
- Office hours are Monday through Thursday from 8 a.m. to 6 p.m., Fridays 8 a.m. to 5 p.m. Please allow 30 minutes prior to close to process marriage licenses
- If you are going to be married in another state, you will need to obtain a license from that state
Application Requirements
- Idaho Statute 32-403
- Applicants Over 18 Years of Age
- Both applicants:
- Need to appear at the courthouse in person
- Must have photo identification
- Must read and sign AIDS pamphlet
- Must fill out marriage license application form
If an applicant has not been issued a social security number as required by Idaho Statute, then written verification must be presented from the Social Security Administration that the applicant has not been assigned a Social Security number; and submit a birth certificate, passport or other documentary evidence issued by an entity other than a state or the United States; and submit such proof as the department may require that the applicant is lawfully present in the United States. The cost is $28.
Two copies of marriage license are issued and filled out by the officiant. One is a ceremonial copy for the couple that serves no legal purpose and the other is returned to the county for recording. Certified copies of this recording may be requested for $2 each.
Applicants Under 18 Years of Age
Same as previously mentioned, plus:
- A parent must appear with applicant and sign an affidavit
- Original or certified copy of birth certificate or other proof of age acceptable to the county recorder
Applicants Under 16 Years of Age
Same as previously mentioned, plus:
- Applicant must obtain a court order from the magistrate judge, and a parent must appear with applicant and sign an affidavit
